Know the Law. Ride Safe.
Electric bikes and scooters are a convenient and environmentally friendly way to travel, but riders should understand the laws and safety requirements that apply in New York State.
What Types Are Legal?
E-Bikes
- Class 1: Pedal-assist only, up to 20 mph.
- Class 2: Throttle-powered and pedal-assist, up to 20 mph.
- Class 3: Up to 25 mph and permitted only in New York City.
E-Scooters
- Electric standing scooters with a maximum legal operating speed of 15 mph.
Basic Rules
- Riders must be at least 16 years old.
- No driver’s license or registration is required.
- Ride only on roads with speed limits of 30 mph or less.
- Use bike lanes when available.
- Sidewalk riding is prohibited.
- Follow all traffic signs and signals.
- Yield to pedestrians.
- Riding under the influence of alcohol or drugs is illegal.
- E-scooters may carry only one rider.
Helmet Requirements
- Required for:
- Riders under 14 on e-bikes.
- All Class 3 e-bike riders.
- E-scooter riders ages 16–17.
- Strongly recommended for everyone, regardless of age.
Required Equipment
When riding after dark, devices must have:
- White front light visible for 500 feet.
- Red or amber rear light visible for 300 feet.
- Side visibility lighting.
- Working brakes, reflectors, and a bell or audible warning device.
Battery Safety
Lithium-ion battery fires can spread rapidly and are difficult to extinguish.
Safety Tips
- Use only certified batteries (look for UL certification).
- Never charge unattended or overnight.
- Unplug chargers when charging is complete.
- Do not use damaged or swollen batteries.
- Charge away from flammable materials and exits.
- Never attempt battery repairs yourself.
- Store devices away from sleeping areas when possible.
If a battery smokes, swells, overheats, or makes unusual sounds, evacuate immediately and call 9-1-1.
Crash Reporting
As of July 11, 2025:
- Police must investigate and report injury-related e-bike and e-scooter crashes to the DMV.
- Serious injury or fatal e-scooter crashes may require operator reporting as well.
A Message to Parents
Children under 16 may not legally operate e-bikes or e-scooters in New York State.
Parents should remind teens to:
- Wear a helmet.
- Stay off sidewalks.
- Follow traffic laws.
- Ride predictably and defensively.
Ride Responsibly
E-bikes and e-scooters are faster and heavier than traditional bicycles, making safe operation especially important. Ride on lower-speed roads, stay visible, and always be aware of pedestrians and other traffic.
